DeltaX Capital LLC · Version 1 · September 18, 2026

Our Commitment to You

DeltaX Capital LLC ("DeltaX," "we," "our," or "us") protects the privacy of prospective, current, and former clients. This notice describes how we collect, use, share, and safeguard nonpublic personal information, meaning personal and financial information that is not publicly available.

We do not sell your nonpublic personal information or share it with other businesses for their own marketing. We disclose it only for the purposes described in this notice, as permitted or required by law.

Information We Collect

We collect information needed to provide our services and meet our legal and regulatory obligations. Sources and examples include:

  • Information you provide. Conversations, questionnaires, applications, agreements, and other records may include your name, address, contact details, date of birth, Social Security or taxpayer identification number, assets, liabilities, income, expenses, tax information, investment objectives, risk tolerance, and investment experience.
  • Account and transaction information. Custodians, brokers, and other financial institutions may provide account numbers, balances, holdings, transactions, fees, and related records needed to service your account.
  • Information from your representatives. We may receive relevant financial information from an accountant, attorney, trustee, or other person you authorize or who is legally entitled to act for you.

How We Use and Share Your Information

We use your information to provide advice, manage and service accounts, process transactions, bill fees, maintain records, and meet legal obligations. The table describes when we may share it with parties outside DeltaX.

Reason for sharing Do we share? Can you limit it?
To service accounts, process transactions, and support advisory operations through financial, technology, and administrative providers Yes No
To meet legal or regulatory requirements, respond to legal process, obtain professional advice, or protect against fraud Yes No
With people or businesses you authorize us in writing to receive your information Yes Yes, for future sharing based solely on that consent
With affiliated or unaffiliated businesses for their own marketing, or through joint marketing arrangements No Not shared

Sharing Details and Your Choices

Depending on the purpose, we may disclose the identification, financial, account, and transaction information described above, limited to what is needed for the service or legally permitted purpose. Recipients may include custodians, brokers, technology and administrative providers, attorneys, accountants, auditors, compliance professionals, regulators, or other parties entitled to receive the information.

Providers that process or store information on our behalf are subject to confidentiality and use restrictions. Where required by law, our agreements prohibit them from using or disclosing the information for purposes outside the service, except as permitted by law. We do not use these arrangements for joint marketing.

The business and legal disclosures described in this notice are permitted without an opt-out right under applicable law. You may withdraw written consent for future sharing that relies solely on your consent by contacting us. This does not stop disclosures otherwise permitted or required by law. If a future change creates an opt-out right, we will give you the required notice and opportunity before that sharing begins.

How We Protect Your Information

We maintain physical, electronic, and procedural safeguards designed to protect your information from unauthorized access or use. We limit access to people and providers who need it for their responsibilities. Our safeguards include access controls, protected storage, secure methods of transmitting information, and appropriate device and account security. We review our safeguards and respond to identified risks. If a security incident occurs, we assess and provide notices required by applicable law.

Former Clients and Record Retention

These privacy protections continue after our relationship ends. We retain information as needed to meet legal, regulatory, and recordkeeping obligations, resolve disputes, and protect legitimate legal interests. Information about former clients may be shared only as described in this notice and as permitted or required by law. We use secure disposal methods after applicable retention requirements and legal holds have ended.

Delivery and Changes to This Policy

We provide this notice at or before the start of our advisory relationship and at least annually while you remain a client. We will promptly update and deliver an amended notice if any information in it becomes inaccurate. Before sharing information in a new way that requires advance notice, consent, or an opportunity to opt out, we will meet those requirements.

Custodians and other financial institutions may provide their own privacy notices. This notice describes DeltaX's practices and does not replace those institutions' notices.
